Divorce Attorney Michael Ian Black Specializes in Resolving Uncontested Divorces Quickly and Cost-Effectively

Uncontested divorce often works for couples in the following circumstances:

  • Couples without children
  • Couples who agree on custodial arrangements
  • Couples with detailed pre-nuptial agreements
  • Couples ending their marriage amicably
  • Couples involved in a myriad of different circumstances

An uncontested divorce can expedite the process, and the proceedings are normally less expensive and faster than in a contested divorce. For many couples, an uncontested divorce lawyer can help spouses avoid a long, drawn-out battle in which the details of their lives must be shared with the court.

While divorce is never easy, an uncontested divorce lawyer in NYC will make the situation less stressful and will ensure the smooth resolution of your divorce. Your attorney will efficiently handle all court proceedings, file the paperwork, and will act as your personal expert adviser.

Michael Ian Black, Esq., is experienced and knowledgeable in divorce and family law. Whether you file an uncontested or contested divorce, the quality of your legal representation is imperative to your future. Clients often find that they are relieved to have someone like Mr. Black guide them through the process and discover that they can more easily move forward with their life after divorce proceedings are finished. Furthermore, an uncontested divorce may become a contested divorce along the way, and it is important to have the best legal representation should you run into terms that are not agreed upon by both parties.

New York’s no-fault divorce law allows spouses to terminate their marriage after stating under oath their marriage has broken down “irretrievably” for a period of six months.

Although the law enables couples to divorce without proving specific grounds, a no-fault divorce cannot be finalized until all ancillary issues have been resolved. These issues include child custody, child support, spousal support, responsibility for payment of counsel fees, and equitable distribution of marital property. For this reason, a no-fault divorce in New York may be either contested or uncontested.

Under the new no-fault divorce law, a spouse seeking a divorce is no longer required to claim fault as the basis for the divorce—a rule that had prolonged and aggravated the already painful divorce process.

Michael Ian Black, Esq., can assist you with the process of filing for a divorce and with managing court costs and attorney fees.

There is now a new set of no-fault divorce laws, which your lawyer must be familiar with. Prior to the new no-fault divorce law, spouses were under obligation to claim and prove that the other committed an act such as adultery, abandonment, or cruelty if filing for divorce. One spouse would have to assign blame to the other in order for the NY court to grant a divorce. The legal criterion would often compel one spouse to make false claims for the marriage to be dissolved.

In many cases, the consequences of this law would be a long, drawn-out, painful, and expensive trial in the New York court system in which each spouse would claim grounds against the other. The new no-fault divorce law is designed to simplify this process and prevent the issues that have arisen due to the previous law. No-fault divorce law ends this rule that forced spouses to invent false justifications for divorce.
